Onki Terms of Service
Effective date: These terms apply from the date shown in the app store listing.
These Terms of Service ("Terms") govern your use of the Onki service ("Service") operated by Cluver Inc. ("we", "us"), a company incorporated in the Republic of Korea. By installing the app or subscribing, you agree to these Terms.
Nothing in these Terms limits or excludes any statutory rights you have as a consumer under the mandatory laws of your country of residence.
1. What the Service is
Onki turns a tablet in your family member's home into a connected photo frame.
- Family members send photos and short videos through WhatsApp; they appear on the frame automatically.
- If a photo carries a caption, the frame can read it aloud, and the frame can play a short morning greeting.
- The person in front of the frame does not need to operate anything.
The Service is a photo-sharing and display product. It is not a monitoring, emergency, medical or safety service, and must not be relied upon as one.
2. Registration and connection
- The frame is registered with a phone number of the household. This number acts as the connection key that family members use to link their chat.
- The first family member who completes verification with the code shown on the frame becomes the household's main contact. Additional family members can send photos after the main contact approves them.
- You must have the consent of the people whose details you enter.
- You are responsible for the accuracy of the phone number you enter. Because this number identifies the household, an incorrect number can cause the frame to be identified as the wrong household, or prevent the person who actually uses that number from registering a frame of their own. We restrict registering or changing a number that is already registered, but we cannot automatically detect a mistyped number that nobody is using yet.
- Once registered, the phone number cannot be changed from the frame. If you entered it incorrectly, please contact us to request a correction; we will verify your identity before making it. In that case our responsibility is limited to making the correction and restoring the connection. We are not liable for delays in registration or for connection mix-ups caused by an incorrectly entered number, except where we have acted with intent or gross negligence.
3. Subscription and payment
- The Service offers a free trial (currently 30 days). During the trial all features are available without entering payment details.
- Paid subscriptions are purchased through the Apple App Store or Google Play. Prices are shown in the store before you buy.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can cancel at any time in your app store account settings; access continues until the end of the paid period.
- If the subscription ends, photos already on the frame continue to display. Caption reading and greetings stop, and the frame shows the most recent photos (currently up to 50).
4. Right of withdrawal (EU/EEA consumers)
If you are a consumer in the EU/EEA, you have a statutory right to withdraw from a distance contract within 14 days. For purchases made through the Apple App Store or Google Play, refund requests are handled by the respective store under their processes; your statutory rights against us remain unaffected. Where you request that the digital service starts immediately and it is fully performed, withdrawal rights may lapse to the extent permitted by law.
5. Photos, videos and other content
1. Rights in the photos, videos and captions ("Content") remain with the sender or their rightful owner. We use Content only to provide the Service (format conversion for the frame screen, automatic display adjustments, reading captions aloud). We do not use Content for advertising and we do not sell it.
2. Senders are responsible for having the necessary rights to the Content they send, including the consent of people shown in photos.
3. A sender can be blocked by the main contact or by us in case of abuse.
4. Photos are not limited in number or storage size. Videos are limited to 30 seconds per video and 20 videos per household per month; the limit resets on the 1st of each month. Photos are unaffected by this limit.
5. The frame is not an archive. Content is stored on the frame device in your family member's home. Our servers keep a copy only for delivery and remove it shortly after the frame has received the Content (see the Privacy Policy). Keep your own originals — if the frame device is lost, reset or replaced, previously delivered Content cannot be restored by us.
6. If a sender deletes a photo through the available channels, it is removed from the frame's rotation.
6. Acceptable use
You must not use the Service to send unlawful content, content that infringes the rights of others, or to harass. We may suspend accounts that abuse the Service, attempt to access other households' frames, or disrupt operation.
7. Availability and changes
- The Service depends on third-party platforms (messaging services, app stores, push notification services). We are not responsible for outages of those platforms, but we will work to restore the Service where the cause is within our control.
- We may modify features with reasonable notice. If a change materially reduces the Service you paid for, you may cancel and, where required by law, receive a pro-rated refund through the applicable store.
8. Liability
- We are liable without limitation for damage caused intentionally or by gross negligence, and for any liability that cannot be excluded by law.
- For slight negligence we are liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for this type of contract.
- The Service displays family photos; it is not fault-tolerant infrastructure for critical purposes and must not be used as such.
9. Termination
- You may stop using the Service at any time by cancelling the subscription and removing the app.
- Upon termination we delete household account data in accordance with the Privacy Policy. Content already delivered to the frame device remains on that device under your control.
10. Governing law and disputes
These Terms are governed by the laws of the Republic of Korea. If you are a consumer in the EU/EEA, you additionally enjoy the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.
